What is sex discrimination? 

Under the Equality Act 2010, it is unlawful for an employer to discriminate against employees because of their sex. 
 
Sex discrimination covers both genders and is illegal against men just as much as it is against women. Also, under the legislation, it is unlawful for a woman to discriminate against another woman because of her sex, and for a man to discriminate against another man because of his sex. 

Examples of sex discrimination 

The Equality Act 2010 states that when making sex discrimination claim you have to have experienced discrimination in one or more of four forms. 

Direct sex discrimination 

Direct sex discrimination is when someone (either male or female) is treated differently and not as well as other people because of their gender. For example, advertising a job and stating it is better suited to female applicants would be illegal as it would discriminate against male applicants. 
 
Direct discrimination breaks down into three different sorts of treating someone 'less favourably' because of: 
 
their own sex (ordinary direct discrimination) 
their perceived sex (direct discrimination by perception) 
their association with someone of a particular sex (direct discrimination by association). 

Indirect sex discrimination 

Indirect sex discrimination can occur where workplace rules, practices or procedures are applied to all staff, but disadvantages those of a particular sex. For example, a requirement in a job advert that states applicants must be six feet tall could be met by significantly fewer women than men. 
 
An employee or job applicant claiming indirect sex discrimination must show how they have been personally disadvantaged, as well as how the discrimination has or would disadvantage other employees or applicants of the same sex. 
 
In a few limited circumstances, indirect discrimination may be justified in law if it is necessary for the business to work. However, employers should note this can be a difficult process to prove. 

Harassment 

Harassment claims are when you engage in unwanted behaviour towards a colleague, related to their sex. Because of this unwanted behaviour, you make them feel upset, humiliated or degraded. Harassment claims break down into one of three different types: 
 
'unwanted conduct' related to a person's sex causing a distressing, humiliating or offensive environment for them 
'unwanted conduct' of a sexual nature - this is sexual harassment 
less favourable treatment of an employee because they have rejected sexual harassment or been the victim of it. 

Victimisation 

Victimisation can be claimed when you treat an employee unfairly because they’ve made a complaint about sex discrimination, or they’re supporting a colleague who has against a company.

tell your manager - put it in writing and keep a dated copy of the letter or email 
talk to your HR team or trade union - they’ll be able to give you advice 
collect evidence - keep a diary recording all of the times you’ve been discriminated against 
raise a formal 'grievance' (complaint) if the discrimination doesn't stop. All employers must have a grievance process - ask your manager or HR team for more information on this 
You could make a claim at an employment tribunal if you can't solve your problem using the grievance procedure.
